New York Introduces End of Life Law

    After years of deliberations, the New York Governor - Kathy Hochul - has signed into law a new bill that will allow terminally ill New Yorkers access to medical help to die.

    While the new law is good news, it is already being described as the most strict in the nation.

    Not only do you need to be diagnosed as terminally ill with < 6 month to live but even after you are prescribed the lethal drugs, you have to wait another 5 days to get your script filled.

    Other impediments (for these are not safeguards, these are hurdles) include:

    • 2 independent doctor assessments PLUS a psychiatric review
    • make a recording of your request for the lethal medication
    Exit’s standpoint is that if you are so sick that death is your preferable option, the last thing you need is to have to jump through hoops such as these in your final days and hours.

    And where does this leave elderly people who, while not seriously ill, have a lot of small things that make their quality of life so poor that they, too, want access to a peaceful death?

    Tough luck! This is the (un)intended consequence of 'medical model' death with dignity.

    According to Philip Nitschke, under the medical model, ‘a good death remains a privilege reserved only for those who are sick.'

    ‘We need to take a human rights approach to dying.’

    'A good death should be a universal human right. The only - and I mean only - criteria should be mental capacity. The rest is irrelevant’ he said.
