Verdict Due 23 December 2025
Will the Dutch join Switzerland, Germany and Austria in de-criminalising assisted suicide?
|
This question shall be answered by the Court of Appeal in the Hague on 23 December 2025 when the verdict of the 4-year prosecution of the Dutch State by activist group CLW will be handed down.
|
On Monday last week, Philip attended the World Trade Centre in the Hague to watch the live-stream of the CLW appeal.
|
To recap, the case began back in April 2021 when 29 members of CLW formed a class action against the State.
|
The purpose was to force the Dutch court to decide on assisted suicide.
|
At the time, the Constitutional courts of both Germany and Austria had ruled that the right to an assisted death is fundamental and is a right of personality - in other words there is a fundamental right of self-determination that the law must respect.
|
While there has been a euthanasia law in the Netherlands since 2002, this law only caters to people who are seriously ill or suffering unbearably.
|
This medical model law has left a large group of older ‘Dutchies’ feeling discriminated against in that their end of life choices are unnecessarily limited.
|
At the current time, the so-called ‘Completed Life Bill’ (a bill that would allow the non-terminally ill elderly to get help to die) is stymied in the Dutch Parliament.
|
The lack of legislative progress by the politicians has further prompted CLW activists to turn to the courts in order for the legislative mess to be addressed.
|
On 23 December, the world will know if the Netherlands has taken a conservative turn on the issue of end of life rights (as many fear). Or will good ol’ Dutch pragmatism will save the day and the Netherlands will again make history on this critical social issue of our time.
