Nembutal Drug Bust

On Friday 6 September, Exit held a workshop on Australia’s Gold Coast.

Initially it was thought that there was nothing extraordinary about the meeting.

It was the 4th of 6 meetings planned for the 2025 Australian Exit Tour.

However when a member of the audience announced in the meeting that he could sell Nembutal to anyone who wanted it, things took a surprising turn.

Exit’s Kerri Dennis moved quickly to eject the man from the meeting.

Philip Nitschke continued the meeting by issuing warnings of the illegality of what had just taken place, emphasising the huge legal risk that participation in the scheme brought to all involved.

Little did Exit know but the Queensland Police had joined the organisation in order to attend this same meeting. Their target was none other than the man who made the announcement, Gold Coast man Brett Taylor.

Brett (and former Exit Gold Coast volunteer Elaine Arch-Rowe) are now alleged by police to be involved in the black market sale of sodium pentobarbital (Nembutal) to Exit members and beyond. They both face several charges.

Elaine is free on bail, while Brett Taylor is detained.

Exit has published a selection of the extensive media coverage on the Exit website along with a short statement from Exit confirming that we had no knowledge of Brett Taylor’s black market business.

Media reports say that the police are focused on Taylor's charity, Cetacean Compassion Australia Ltd, which they say he set up to provide euthanasia for whales and other large mammals such as dolphins that become stranded on Australia’s vast coastline.

The police are also saying that the group was set up by Taylor so that Nembutal could be sold in a black market scheme to elderly people around Australia.

What is especially concerning to everyone at Exit is the apparent way in which Taylor has used Elaine Arch-Rowe (in the years after her husband Peter passed away) in order to infiltrate our organisation.

Elaine has been involved as a volunteer with Exit for over 20 years. She is much loved and trusted by everyone who knows her.

Her sense of compassion for those at the end of life is well known.

Sadly Elaine is not the first woman to be used by a ‘drug ring kingpin’ (media’s words) to be his drug mule. She will likely not be the last.

Last Friday, the bill passed the second reading stage.

The Exit workshop will examine why the proposed bill does not go nearly far enough in providing elderly people with real end of life options.

Future of Sarco?

Tuesday 23 September marks the first anniversary since Sarco was ‘successfully’ and lawfully used in a remote forest of Schaffhausen canton in Switzerland.

The user of the Sarco was a seriously ill American woman who flew to Europe a few days before she was to die.

The woman had a background in the sciences and understood how the Sarco was intended to work. She had few concerns. She said she trusted the science.

Exit was pleased that her faith in the Sarco was rewarded by what was a fast and peaceful passing.

One year on from her death, she is remembered fondly, and with enormous respect.

The same cannot be said for the prosecutorial office of Schaffhausen who have still not interviewed Philip Nitschke (the creator of the Sarco).

One would assume that this interview is critical, given that Philip is now the only person alive who can testify to the operation of the Sarco and to the nature of the woman’s death.

Instead, the prosecutor is pursuing Exit in the Swiss Federal Court as they seek access to Exit’s privileged legal advice* in the years leading up to 23 September 2024.

*Legal privilege refers to the right that protects communications between a lawyer and their client from being disclosed. This principle ensures that clients can seek legal advice freely and confidentially, fostering open communication with their legal representatives.

Legal privilege is crucial to the maintenance of the integrity of the legal system and to the rule of law.

MOST TRAGIC

The most tragic and unncessary consequence of the first use of Sarco is the needless suicide of the President of the Last Resort, Florian Willet.

Florian was the only person present when the Sarco was used.

However, instead of investigating an assisted suicide the prosecutor went straight for a charge of ‘intentional homicide'.

Florian was incarcerated in what is quaintly called ‘pre trial detention’ for 70 days in one of Switzerland’s most notorious prisons. See the report of the Swiss National Commission for the Prevention of Torture (Wikipedia.de).

All the while, the video footage and oxygen trace monitoring (which proved the woman was not assisted) was in the possession of the Schaffhausen authorities.

These recordings show that Florian was nothing more than a witness to the suicide that took place.

Yet, as Florian would later claim, there he was in a jail cell, watching himself on TV being accused of being a murderer and facing indefinite incarceration.

It is not surprising that in January 2025, Florian would be diagnosed with an acute psychotic disorder by the Zurich Psychiatric Klinik.

In his psychiatric report, the cause of his psychosis 'developed following the stress of the pre-trial detention and the associated processes’.

Florian never recovered from the psychosis.

He died by assisted suicide in Germany on 5 May 2025. He was 47.

LOOKING FORWARD

Exit is currently defending the Sarco against the Schaffhausen prosecutor in both the Swiss and Dutch courts.

A new ‘Double Dutch’ Sarco is currently being printed in the Netherlands since the Schaffhausen prosecutor has possession of the Sarco that was used.

The non-functioning display Sarco (from Venice Design 2019) is currently the subject of an extradition request by the Schaffhausen prosecutor and is before the Dutch Supreme Court.
