Is this Swiss Justice?
At around 18.00 on 23 September 2024, following the successful first use of Sarco, Dr Florian Willet, President of The Last Resort was arrested & detained by Swiss Police.
|
Following legal advice, Florian was the only person present at the time the Sarco was used. He was expected to be interviewed and allowed to go home the same night.
|
Despite these best laid plans, Florian has now been held in a Swiss prison for ‘pre-trial detention’ for 55 days, and counting.
|
Meanwhile, the Swiss prosecutor seems to be alleging that the woman did not die in the Sarco. Rather, that Florian murdered her.
|
At their first court appearance in September, the Prosecution is reported to have used a ‘ph0ne note’ from an unnamed 'forensic doctor’ to argue that the user ‘may have been strangled’ due to alleged ’severe injuries to the neck’.
|
With no autopsy report, few facts exist.
|
Last week in court, Florian’s ongoing detention was appealed. The appeal failed.
|
However, during this hearing the prosecution admitted that no DNA of Florian’s was found on the neck of the woman.
|

Yet still Florian remains in jail?
|
The investigation by the Schaffhausen prosecutor has now come under attack from Florian’s lawyer, Petar Hrovat who was interviewed this week by Swiss newspaper, NZZ.
|
Hrovat’s assessment is scathing and raises serious questions about the way the matter is being handled.
|

The last Exit Podcast on Sarco was back in August 2020, at the height of the pandemic.
|
This week, the topic is revisited given the legal (and political) machinations which surround the Sarco project following the first use of the device in Schaffhausen last September.
|

Tell Florian You Care
Back in July, Donald Trump claimed that he ‘took a bullet for democracy’.
|
Regardless of what you think of the American election result, the same analogy can perhaps be used for Florian Willet.
|
By volunteering to be the sole person present when the Sarco was used for the first time in Switzerland, an act derived purely from altruistic motives, Florian has ‘taken a bullet’ for the rest of us.
|
Florian stepped up to the plate, precisely when needed.
|
Florian’s brave presence at the first use of the Sarco benefits:
|
- everyone who shares the fundamental belief that a good death is a human right.
- everyone who believes that the Sarco is one of the most important paradigm shifts in terms of de-medicalising and democractising assisted death
- everyone who hopes that Switzerland will ultimately welcome the arrival of Sarco in their progressive, liberal country
- everyone who thinks that one day they might wish to use the Sarco in Switzerland (or at home)
One way to support Florian is to send him messages while he is in jail.

All letters will be read / censored by the Swiss prosecutor. The prosecutor has sole discretion over what gets through to Florian.
|
Be that as it may, let’s show Florian our gratitude. Let’s cheer his day. Let’s show him that he is not alone. Let’s thank him.

Are Bragging Rights Worth It?
Just when we thought the UK’s 'Terminally Ill Adults (End of Life) Bill' could not become less 'fit for purpose', we take a close look at what is being proposed (and weep).
|
Not only must the patient (not person) be about to die < 6 months but they must:
|
- make 2 written/ signed/ witnessed applications for help to die
- be assessed by doctor no. 1
- wait >7 days
- be assesssed by doctor no 2
- have their case (& possibly themselves) presented to a High Court judge
- wait another 14 days
And for what? For the right to a peaceful death at a time of their choosing.

Pandering to the anti-choice lobby through more and more so-called 'safeguards' is a race to the bottom in terms of human rights.
